A divorce is the legal procedure that ends a marriage. To get a divorce in Singapore, you will need to file for a divorce with the Family Justice Courts (Civil marriages) or the Syariah Court (Muslim marriages). However, there are two pre-conditions before one can divorce in Singapore.

Pre-Conditions for Divorce

1. Married for at least 3 years

To get a divorce in Singapore, you have to be married for at least 3 years. In special cases, a divorce can be filed before 3 years of marriage have passed. However, you will have to prove that you have suffered exceptional hardship or if your spouse has been exceptionally unreasonable and cruel. This will be elaborated in a separate article.

2. Relation to Singapore

In addition, to obtain a divorce in Singapore, you or your spouse must be domiciled (i.e. have treated Singapore as your permanent abode) at the start of the divorce proceedings. For example, either you or your spouse is a Singapore Citizen. If neither of you are Singapore Citizens, then either of you must have resided in Singapore for at least 3 years immediately before the commencement of divorce proceedings – this is the habitually resident rule.
