Legal Grounds for Divorce

Legal Grounds for Divorce

In Singapore, for there to be a divorce, there has to be an “irretrievable breakdown” of the marriage. This is the sole ground of divorce. In order to show an irretrievable breakdown of the marriage, you have to prove at least one of five legally defined facts. The five facts that can be used to obtain a divorce in Singapore are as follows:

  1. Adultery;

  2. Unreasonable behaviour;

  3. Desertion for more than 2 years;

  4. Separation for more than 3 years with consent from your spouse; and

  5. Separation for more than 4 years.

A sixth fact of “mutual agreement” will also be introduced sometime in the second quarter of 2023.

If you are unable to establish the ground of divorce, you are unable to proceed with a divorce.

In the next few articles, we will elaborate in detail each ground of divorce.

  • 通奸;

  • 不合理的行为;

  • 遗弃2年以上;
